Terms of Use

For the purposes of these Terms of Use, Vega Yapısal Ürünler San. ve Tic. A.Ş shall be referred to as the "Company", sunflex.com as the "Website", and visitors to the website as the "User".

This agreement imposes rights and obligations on the parties regarding the Website that is the subject of this agreement. By accepting this agreement, the parties declare that they will fulfill such rights and obligations completely, accurately, and in a timely manner in accordance with the conditions specified herein.

The Company reserves the right to make changes to prices and the products and services offered at any time. The Company agrees and undertakes that the member will be able to benefit from the services subject to this agreement, except in cases of technical malfunction.

The User agrees in advance that they will not reverse engineer the Website or engage in any other activity intended to discover or obtain its source code. Otherwise, the User shall be responsible for any damages caused to third parties and may be subject to legal and criminal proceedings.

The User agrees not to create or share content in connection with activities on the Website, any part of the Website, or communications that is contrary to public morality and accepted standards, unlawful, infringes the rights of third parties, misleading, offensive, obscene, pornographic, infringes personal rights, violates copyrights, or encourages illegal activities. The User shall be fully responsible for any resulting damage. In such cases, Website administrators may suspend or terminate such accounts and reserve the right to initiate legal proceedings.

All registered or unregistered intellectual property rights contained on this Website, including titles, trade names, trademarks, patents, logos, designs, information, and methods, belong to the company operating and owning the Website or to the relevant identified rights holder and are protected by national and international law. Visiting this Website or making use of the services offered on this Website does not grant any rights with respect to such intellectual property rights.

Information contained on the Website may not be reproduced, published, copied, presented and/or transferred in any manner. The Website, in whole or in part, may not be used on another website without permission.

The Company shall not disclose personal information provided by Users through the Website to third parties. Such personal information includes the User's name and surname, address, telephone number, mobile phone number, email address, and any other information that may identify the User, and shall hereinafter be referred to as "Confidential Information".

The User agrees and declares that the company owning the Website may share the User's contact information, portfolio information, and demographic information with its affiliates or group companies solely for the purposes of promotional, advertising, campaign, promotion, announcement, and similar marketing activities.

Confidential Information may only be disclosed to official authorities where such information is duly requested by the authorities and where disclosure is mandatory pursuant to applicable mandatory legal provisions.

This provision shall apply to the maximum extent permitted by applicable law. Services provided by the Company are offered on an "as is" and "as available" basis, and no express or implied, statutory or other warranties are made regarding the services or their use, including all implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

The User must provide accurate, complete, and up-to-date registration information. Otherwise, this Agreement shall be deemed to have been breached and the User's account may be closed without prior notice. The User is responsible for the security of their password and account on the Website and third-party websites. The Company cannot be held responsible for any resulting data loss, security breach, or damage to hardware and devices.

The Company reserves the right to change the prices of products sold on the Website at any time without prior notice. The Company confirms sales made through the Website after payment has been completed.

If the product price stated in written, visual, or social media advertisements and promotions differs from the price displayed on the Website, the price displayed on the Website shall prevail.

The Company cannot be held responsible for price differences between products sold on other sales platforms, e-commerce websites, or by suppliers and the products sold on the Website. In such cases, the current price displayed on the Website shall prevail. All prices stated on the Website exclude installation and timber. In addition, for sales made outside the country, shipping and tax costs shall be borne by the User.

The Company endeavors to describe the products available on the Website to Users as accurately as possible. However, it does not guarantee that the content is error-free, complete, or current. If the User considers a product description insufficient, they may contact the Company.

The Company endeavors to present the products available on the Website to Users through high-quality and informative images. However, image quality may vary depending on the User's monitor. The Company cannot be held responsible for such differences.

Until the User receives the product, all risk of loss or theft relating to the product shall remain with the Company. Once the User has received the product, all risk of loss or theft shall pass to the User.

If the obligations arising from this agreement become impossible to perform due to circumstances beyond the control of the parties, including natural disasters, fires, explosions, civil wars, wars, uprisings, civil unrest, mobilization, strikes, lockouts, epidemics, infrastructure and internet failures, or power outages, the parties shall not be held responsible. During such period, the Parties' rights and obligations arising from this Agreement shall be suspended.

If any provision of this agreement becomes partially or entirely invalid, the remaining provisions of the agreement shall continue to remain valid.

All notices to be sent to the parties regarding this Agreement shall be made through the Company's known email address and the email address provided by the User in the membership form. The User agrees that the address provided during registration shall constitute a valid address for notification purposes and that, in the event of a change, the User shall notify the other party in writing within 5 days; otherwise, notices sent to the previously provided address shall be deemed valid.

In any dispute that may arise between the parties in connection with transactions relating to this agreement, the Parties' books, records and documents, computer records, and fax records shall be accepted as evidence in accordance with Turkish Code of Civil Procedure No. 6100, and the User agrees not to object to such records.

The Courts and Enforcement Offices of Istanbul (Central) Courthouse shall have jurisdiction over any disputes arising from the implementation or interpretation of this Agreement.
